Re: divorce details
What is available is detailed on the National Archives site http://www.nationalarchives.gov.uk/reco ... ivorce.htm
Just a word of warning that the survival rate of divorce case files after 1937 is less than 0.2%.

Re: divorce details
Hi Kitty90
It sounds like you're researching a wartime separation same as me. I've ordered a service record to get more information about the family situation at the time. Here is some information about divorce records:-

While the full details of a divorce after 1937 may not be available, there's a good chance you can get a copy of the Decree Absolute. See here: http://www.nationalarchives.gov.uk/reco ... lp=rg-3175
You should narrow the time span as much as possible so a search can be done more fully for you. You will need to download and complete Form D440 and submit it with the appropriate fee.
If you know when one of the parties married again that would give you a rough pointer as to when the Decree was finally granted. For instance the only marriage in Lancashire of a Mary V McCabe between 1945 and 1955, was in the September qtr of 1955. Often the wartime infidelity of one party, if that was the cause, did not come to light until the other party returned to civilian life. From my experience in checking for 'wartime' divorces, these usually happened after the end of the war, between 1945 and 1955.
Of interest from http://www.legalarticles.co.uk/a-brief- ... h-century/
In 1937 the law was amended again and now three other grounds for divorce were added. The private members bill introduced was introduced by A P Herbert. The new ground for divorce that were added to that of adultery were cruelty, desertion (for at least three years), and incurable insanity. However people were unable to divorce within the first three years of their marriage as this clause was included within part of the act.
